These Terms of Service ("Terms") govern your use of the Witan platform ("Witan", "the service"). The provider of the service is Leo Rafael Pritz, Vienna, Austria. Full provider details are available in our Imprint.
By signing in to Witan via Google or Discord OAuth, you accept these Terms and our Privacy Policy. If you do not agree, do not use the service.
Contract formation details (Information per § 9 ECG):

Witan is intended for users aged 14 or older, in line with § 4 (4) of the Austrian Data Protection Act (DSG 2018), which sets the minimum age for consent to information-society services in Austria at 14. Witan is intended for one account per person. By creating an account, you confirm that the information provided by your OAuth provider (name, email, avatar) belongs to you.
You are responsible for keeping your OAuth provider credentials secure (your Google or Discord account). Notify us promptly at usewitan@gmail.com if you suspect unauthorised access to your Witan account.
Witan is an AI-assisted learning platform. It generates quizzes, flashcards, and explanations from sources you provide, and tracks your learning progress using spaced repetition. Features may be added, changed, or removed as the service evolves.
Witan is a learning tool, not an examination, tutoring, or certification service, and not a school or any other educational institution. Neither the provider nor the AI is a qualified teacher, instructor, subject-matter expert, or professional advisor in any field — including academic, medical, legal, financial, or safety-related subjects.
We do not promise any specific learning outcome, grade, examination pass, qualification, admission, or professional advancement. You are solely responsible for:
own authoritative materials (textbooks, lecture notes, official curricula, primary sources, qualified instructors);
assignment.
All AI-generated content — questions, explanations, summaries, feedback, and any other output — may be factually incorrect, misleading, incomplete, or entirely fabricated ("hallucinations"). The AI does not understand the subject matter; it predicts plausible-looking text. Treat every piece of AI output as a starting point that requires independent verification, never as a final or reliable answer.
Within the limits set out in our Liability section below, we accept no liability for grades, examination outcomes, course failures, missed deadlines, lost study time, reliance on AI-generated content, or any educational, professional, financial, medical, legal, or safety-related consequences arising from your use of Witan.
Witan is currently in beta. The service is provided for evaluation and learning purposes; uptime, data persistence, and feature scope may change. Witan is free of charge during the beta phase.
To keep the service sustainable, beta accounts have a fair-use limit of 20,000 AI tokens per 7-day window (input and output combined, counted 1:1 against OpenAI usage). The window resets every Monday at 00:00 UTC. Per quiz set, you can generate up to 5 questions from up to 1 source. Current usage and the next reset time are visible in the Settings → Usage panel; the app shows in-app warnings as you approach your limit. These limits are enforced automatically by the system: once your weekly allowance is reached, AI features become temporarily unavailable until the next reset, while your account and non-AI features remain accessible. These limits may be adjusted to keep operating costs viable; we will give reasonable advance notice via channels available to us before any reduction.
We will give reasonable notice (at least 30 days) before discontinuing the service entirely.
Your use of Witan must comply with our Acceptable Use Policy. The AUP describes permitted and prohibited conduct, including limits on automated scraping, account sharing, and generation of unlawful content.
You retain ownership of any source material (text, notes, documents) you upload or paste into Witan.
You warrant that you have all necessary rights, licences, and permissions to upload, process, and use any source material with Witan, and that doing so does not violate copyright, trademark, privacy, confidentiality, or other rights of any third party. You are solely responsible for the legality of the material you provide.
You grant us a limited, non-exclusive license to process this content solely to provide the service to you.
AI-generated output (questions, explanations, summaries) is produced on your behalf by OpenAI's API. Your inputs and outputs are processed under our OpenAI API contract; according to OpenAI's standard API policy, API data is not used to train OpenAI's models. We do not use your content to train any AI model of our own, and we do not sell, share, or license your content to third parties for training purposes. You may use AI output freely for your personal learning. AI output can be inaccurate or incomplete — please verify important information independently.
To deliver the service, we rely on the following subprocessors which may process your data on our behalf: OpenAI (AI inference), Supabase (database and authentication), and Vercel (hosting and content delivery). Their roles, data categories, and safeguards are described in our Privacy Policy.
How we process personal data is described in our Privacy Policy.
We are liable for damages caused by intent or gross negligence in accordance with statutory law.
For slight negligence, our liability is limited to the foreseeable, contract-typical damage and only for breach of those obligations whose fulfilment is essential to the proper performance of these Terms and on whose compliance you as user may reasonably rely.
Liability for personal injury and under the Austrian Product Liability Act (PHG) remains unaffected.
Statutory warranty rights of consumers under Austrian law apply. Nothing in these Terms limits those rights.
You may delete your account at any time via Settings → Account → Delete Account. Deletion is immediate and irreversible. When you confirm, your authentication record and all data linked to your account — user profile, settings, uploaded sources, quiz sets, items, learning sessions, FSRS state, AI explanations, and error-pattern analyses — are removed atomically across all internal tables. Your active session is invalidated, and we verify after each deletion that no rows remain in any table linked to your account.
All learning analytics we produce for you (progress, mastery, retention curves, error patterns) are stored only in connection with your account, serve to give you a clearer picture of your learning progress, and are deleted together with your account. Aggregate metrics that no longer identify you (e.g., total platform load) and any short-lived logs held by our subprocessors (OpenAI, Supabase, Vercel) are governed by the retention policies described in our Privacy Policy.
Before deletion, you may request a copy of your personal data in a structured, machine-readable format (Art. 20 GDPR) — either via the in-app data-export feature or by writing to usewitan@gmail.com; we will respond within one month.
We may suspend or terminate accounts that violate these Terms or the Acceptable Use Policy. If we do so, we will provide you with a reasoned explanation of the action and the grounds for it (Art. 17 EU Digital Services Act); you may contest the decision by replying to usewitan@gmail.com, and we will review your appeal in good faith.
If we discontinue the service entirely, we will give at least 30 days' advance notice. Within that period you may export your data via the in-app data-export feature or delete your account; on the discontinuation date, all remaining user data is removed.
We may update these Terms. We will notify registered users of any material changes at least 30 days before they take effect via an in-app notice — typically a banner shown after sign-in and, for material changes, a re-acceptance prompt that requires you to confirm the new Terms before continuing to use the service. The current version, together with its effective date, is always shown at the top of /legal/terms.
If you do not agree with the changes, you may delete your account before the new Terms take effect; this counts as ordinary termination.
These Terms are governed by Austrian law. Consumers domiciled in the EU retain the protection of the mandatory provisions of the law of their country of habitual residence (Art. 6 Rome I Regulation). Consumers may bring proceedings in the courts of their place of residence (§ 14 KSchG).
