This Acceptable Use Policy ("AUP") forms an integral part of the Witan Terms of Service. It applies to every visitor, registered user, and any automated agent acting on a user's behalf. By accessing or using Witan you agree to this AUP. Where the ToS and this AUP overlap (eligibility, liability, termination framework), the ToS prevails; this AUP adds the conduct rules.

User Content means any data, files, prompts, ratings, messages, source material, or other inputs you submit to Witan.
AI Output means content generated by the Witan platform in response to your inputs (questions, explanations, summaries, flashcards).
You are responsible for User Content. We are responsible for AI Output, subject to the limitations in Sections 5 and 10 of the Terms of Service.
You may only submit User Content that:
exception (e.g. § 42 UrhG private use, where applicable);
lawful basis under Art. 6 GDPR (and Art. 9 GDPR for special categories such as health, biometrics, or political views).
Note that User Content you submit, the questions Witan generates from it, and the answers you give are processed by AI models and indexed in machine-readable vector form so we can deduplicate generated questions and, optionally, surface patterns in your mistakes. The purposes and retention periods are listed in the Privacy Policy §§ 3, 7 and 9.
You must not upload, generate, share, store, or distribute content that falls into any of the categories below. This list is not exhaustive but defines the categories we will always treat as violations.
Illegal or criminal content:
protected groups (§ 283 StGB Verhetzung);
(§§ 278b–278e StGB; Regulation (EU) 2021/784);
(Verbotsgesetz 1947, §§ 3g, 3h);
(§ 207a StGB);
chemical/biological agents (§ 282a StGB);
(§§ 104a, 217 StGB).
Intellectual-property and rights violations:
licence or statutory permission, including commercial textbooks, university scripts, or third-party teaching materials (§§ 14 ff. UrhG);
watermarks (§ 90c UrhG);
(§§ 16, 1330 ABGB; § 78 KUG).
Privacy violations:
addresses without lawful basis;
hints (§ 107a StGB);
ground, or special-category data without Art. 9 GDPR ground.
Security or malicious content:
StGB);
context;
Deceptive content:
labelling (Art. 50 AI Act);
You must not:
browsers, bots) without our prior written consent;
authentication;
account with others;
bombs, resource-exhaustion attacks);
model weights, system prompts, or proprietary configurations;
conceal automated access;
written consent;
Security research carve-out. Good-faith vulnerability research is welcome. If you find a security issue, report it to usewitan@gmail.com before disclosure. Do not access, modify, or exfiltrate data belonging to other users while testing, and respect rate limits.
You must not use Witan to:
(Regulation (EU) 2024/1689), including subliminal manipulation, exploitation of vulnerabilities, social scoring, or unlawful emotion recognition or biometric categorisation;
safety guardrails;
CSAM, hate speech, weapon instructions, or non-consensual intimate imagery);
academic-integrity rules require AI-authorship to be disclosed (Art. 50 AI Act);
or scraped responses.
You agree not to use Witan during any supervised or non-cooperative assessment — including exams, take-home tests, certification attempts, or admission tests — where AI assistance is not expressly permitted by the institution responsible for the assessment.
When you submit Witan-generated material as part of an academic assignment, you are solely responsible for complying with your institution's AI-disclosure and authorship rules.
You also confirm that you hold the necessary rights to any teaching material you upload as a source: own notes, openly licensed content, public-domain works, or material covered by a specific licence. Uploading commercial textbooks, scanned lecture scripts, or other third-party copyrighted material without the rights-holder's consent is a violation of this AUP and may also breach §§ 14 ff. UrhG.

If you believe content on Witan is illegal, please report it to usewitan@gmail.com with:
including the legal basis (e.g. the statute or right involved);
where the law allows);
accurate and complete.
We acknowledge receipt without undue delay and decide on the report in a diligent, non-arbitrary, and objective manner. Decisions are made by a natural person; no automated final decisions are taken on notices about illegal content.
If we determine that User Content or your use of the service violates this AUP, the ToS, or the law, we may apply one or more of:
We apply the least intrusive measure that is appropriate to the violation. Repeated or serious violations may justify immediate escalation.
Every enforcement action comes with a written Statement of Reasons identifying:

You may appeal any enforcement decision, free of charge, within six months of receiving the Statement of Reasons by replying to usewitan@gmail.com. Please include the reference from the Statement of Reasons and any additional facts you would like us to consider.
Complaints are reviewed by a natural person — not solely by automated means — and decided without undue delay. If we reverse the decision, the restriction is lifted promptly and without further request from you. If we uphold the decision, you may also turn to an out-of-court dispute-resolution body or to the competent courts; the EU online dispute resolution platform is available at https://ec.europa.eu/consumers/odr.
This AUP procedure does not replace your statutory rights or judicial remedies. We cooperate with Austrian and EU authorities (police, public prosecutors, KommAustria, RTR-GmbH, and the Austrian Data Protection Authority) on the basis of lawful orders, in particular under Articles 9 and 10 of the Digital Services Act and § 76a of the Austrian Code of Criminal Procedure (StPO).
We may amend this AUP for legal, regulatory, security, or product reasons. We notify registered users by the most appropriate channel available — typically an in-app banner and, where we hold a usable email address, by email — at least 30 days before changes take effect. Continued use after the effective date is deemed acceptance. You may delete your account before the new version takes effect if you do not agree (this counts as ordinary termination under Section 12 of the Terms of Service). Minor editorial changes (typos, formatting, link updates) do not trigger a notice.
